A road rage incident in the South Beach area of Miami Beach, Fla., precipitated the arrest of Broncos defensive end Elvis Dumervil on suspicion of aggravated assault with a deadly weapon, according to a Miami Beach police report.
The incident occurred Saturday about 5 p.m. EDT on Collins Avenue, which is one block off the famous Ocean Drive strip. The police report alleges that Dumervil and his friend, Andy Auguste, left their vehicles, approached the occupants of a white Impala and lifted their shirts, each displaying a gun.
Two sources close to Dumervil, however, said Monday he was not carrying a gun. The police report states a gun was found in the vehicle Dumervil was driving, but the sources say the vehicle and gun did not belong to Dumvervil.
According to the report, Dumervil was driving a Land Rover and following a gray Mercedes, which Auguste was riding in as a passenger. When the Impala merged between the Land Rover driven by Dumervil and the Mercedes, an argument ensued. There was horn blowing, verbal threats and name calling.
The accusers in the Impala stated that Dumervil and Auguste approached them and displayed their firearms as traffic was at a standstill. An employee at Victoria’s Secret witnessed the incident and called police. According to the police report, much of her statement concurred with the alleged victim’s statements, though the witness added that the passenger victim got out of the Impala and yelled back in the direction of the vehicle Dumervil was driving. The Victoria’s Secret employee stated that during the argument, the driver of the Impala threw an unknown object that struck the Land Rover driven by Dumervil.
The Land Rover was stopped in traffic when police arrived. Dumervil was ordered out of the car at gunpoint and was placed in handcuffs. The officer at the scene asked Dumervil “if there was a gun in his car, and he stated no,” according to the police report. The officer then found a gun in the vehicle’s glove compartment. Dumervil was taken to jail and the Land Rover was towed. Auguste also was arrested on suspicion of aggravated assault with a deadly weapon, a third-degree felony in Florida.
Dumervil, 28, was released after posting $7,500 bail. His agent, Marty Magid, said he expected the matter will be dismissed once the investigation is completed. Dumervil’s attorney, Denver-based Harvey Steinberg, declined to comment until the investigation is completed.
Dumervil is a two-time Pro Bowler who led the NFL with a Broncos-record 17 sacks in 2009.
In 2010, Dumervil was cited for disturbing the peace and assault in connection with an incident at the Broncos’ home game against the Oakland Raiders. At the time, Steinberg said Dumervil forgot his credentials and a security guard refused to let him in the stadium’s entrance for players. Words were exchanged, but the matter was settled when another Broncos official vouched for Dumervil and he was allowed into the stadium, Steinberg said.
Court records show Dumervil has pleaded guilty in six traffic cases in Littleton, Aurora and Douglas County since 2006, including charges of speeding more than 20 mph over the speed limit and driving with a suspended license.
